Domala Aide Services Terms & Conditions
1. Introduction
A. These terms and conditions ("Terms") govern the use of services made available on or through https://www.Domsaideservices.com and/or the Domala Aide Services mobile app (collectively, the "Platform", and together with the services made available on or through the Platform, the "Services"). These Terms also include our Privacy Policy, available at [Privacy Policy URL] ("Privacy Policy"), and any guidelines, additional, or supplemental terms, policies, and disclaimers issued by us from time to time ("Supplemental Terms"). The Privacy Policy and the Supplemental Terms form an integral part of these Terms. In the event of a conflict between these Terms and the Supplemental Terms with respect to applicable Services, the Supplemental Terms will prevail.
B. The Terms constitute a binding and enforceable legal contract between Domala Aide Services Private Limited ("we," "our," "us," or "DAS") with its registered address at [Insert Address], and you, a user of the Services, or any legal entity that books services ("you" or "Customer"). By using the Services, you represent and warrant that you have full legal capacity and authority to agree to and bind yourself to these Terms. If you represent any other person, you confirm and represent that you have the necessary power and authority to bind such person to these Terms.
C. By using the Services, you agree that you have read, understood, and are bound by these Terms, as amended from time to time, and that you will comply with the requirements listed here. These Terms expressly supersede any prior written agreements with you. If you do not agree to these Terms, or comply with the requirements listed here, please do not use the Services.
2. Services
- (a) The Services include the provision of the Platform that enables you to arrange and schedule different services with independent third-party service providers ("Domala Aide Services Buddies"). As part of the Services, DAS facilitates the transfer of payments to Domala Aide Services Buddies for the services they render to you and collects payments on their behalf.
- (b) The services rendered by Domala Aide Services Buddies are referred to as "Pro Services".
- (c) The Platform is for your personal and non-commercial use only, unless otherwise agreed upon in a separate agreement. The Platform is intended for use only within India. By availing Services outside India, you agree to be bound by DAS terms applicable to that jurisdiction.
- (d) DAS may send you SMS, email, or WhatsApp messages regarding bookings, usage of the Services, or promotional purposes. You may opt out of receiving such messages, but this may impact our ability to provide Services.
- (e) You may be required to provide identification proof to avail Services or Pro Services. Failure to do so may restrict your use of the Platform.
3. Account Creation
- (a) You must create an account ("Account") on the Platform to avail Services. Certain details, such as your phone number, may be required. You must be at least 18 years old.
- (b) You warrant that all information provided is accurate and you must update any changes promptly.
- (c) You are solely responsible for securing your Account and must notify DAS immediately of any unauthorized use.
- (d) You are accountable for all activity via your Account, including that by others. DAS is not liable for unauthorized access.
- (e) You agree to receive communications from DAS regarding payments, Service updates, promotional offers, and other matters related to the Services.
4. User Content
- (a) The Platform may allow users to post, upload, publish, or submit comments, reviews, feedback, or other content ("User Content").
- (b) DAS may request reviews of Domala Aide Services Buddies and Customers. You must not provide false or misleading information. Reviews may be used to determine appropriate users and for quality control. DAS may cancel registration if a user is deemed inappropriate.
- (c) DAS may remove or restrict access to User Content that violates these Terms without prior notice.
5. Consent to Use Data
- (a) By using the Services, you consent to DAS collecting and using your personal data in accordance with the Privacy Policy.
- (b) You consent to DAS sharing your information with affiliates or third-party service providers for analytics, trends, statistics, new offers, and improving the effectiveness of Services.
- (c) DAS may disclose data to law enforcement or government agencies as required by law.
6. Bookings
- (a) Orders: You may request Pro Services based on available timeslots. DAS will use reasonable efforts to match you with a Domala Aide Services Buddy.
- (b) Confirmation: You will receive booking confirmation via SMS, email, or push notification. Payment may be required as indicated.
- (c) Cancellations: Cancellations before confirmation incur no charges. DAS cancellation policy applies for confirmed bookings.
- (d) Substitution: If a selected Domala Aide Services Buddy is unavailable, DAS may provide a substitute from among registered buddies.
7. Pricing, Fees, and Payment Terms
- (a) DAS reserves the right to charge for Services and additional facilities on the Platform.
- (b) Charges and Fees for Pro Services:
- (i) You shall pay Domala Aide Services Buddies for services requested, including additional services, expenses incurred, or goods required. DAS may charge a convenience fee.
- (ii) DAS will notify you of applicable Charges, Fees, and payment methods. Payment can be made via credit/debit cards, net banking, wallets, UPI, or cash upon completion.
- (iii) Charges and Fees may be payable at booking or upon completion as specified.
- (iv) Charges are payable to Domala Aide Services Buddies; DAS acts as a limited collection agent.
- (v) Charges and Fees include applicable taxes.
- (vi) DAS may amend Charges and Fees at its discretion. Changes do not affect already confirmed bookings.
- (vii) Charges and Fees are generally non-refundable unless required by law.
- (viii) Charges may increase during high-demand periods. You are responsible for Charges and Fees under your Account.
- (c) Payment Processors: DAS may use third-party payment processors. DAS is not liable for errors by Payment Processors. Unsuccessful payments will be handled according to processor policies.
- (d) Cancellation Fees: Cancellation prior to a buddy’s arrival may incur fees as per DAS policy.
8. Customer Conduct
- (a) DAS prohibits discrimination against Domala Aide Services Buddies based on race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or other protected characteristics.
- (b) Customers must treat buddies with respect and provide safe, clean locations. Buddies may refuse service if conditions are unsafe or customer behavior is inappropriate. DAS may limit access to Services at its discretion.
- (c) Customers are liable for failure to provide safe locations or discriminatory behavior. Relevant information impacting buddy safety must be disclosed.
- (d) Report inappropriate behavior by a buddy to domsaideservices.com within 72 hours.
9. Third-Party Services
- (a) The Platform may include services, content, or information from third parties ("Third Party Services") and links thereto. You use Third Party Services at your own risk.
- (b) DAS is not responsible for the accuracy, completeness, or availability of Third Party Services. Use of Third Party Services is governed by their terms and policies.
